4.MATERIAL COMPLIANCE REQUIREMENTS
4.1Regulatory requirements regarding material compliance
4.1.1Candidate list published by the European Chemical Agency1 (EChA)
L’OREAL prohibits the use of any POS and promotional items containing a substance classed as “of very high concern” (SVHC) as identified in the candidate list published by the EChA and present in a quantity-greater than 0.1% in weight of the article.
L’OREAL considers the position taken by several Member States that an article that has been incorporated in another article always remains an article: “once an article – always an article”.
An article is defined by L’Oreal as an item - possibly made up of several constituents - which ensure a function as a whole.
Example: a POS table
A POS table is made up of:
1/ a table top. Function = providing support to the items placed upon it
2/ a leg: 4 elements = leg and 3 screws. Function = providing contact with the floor
0As a conclusion a POS table is made up of 2 articles.
0So the quantity of SVHC must be inferior to 0.1% in weight in both the table top and the leg.
4.1.2Substances classed as carcinogenic, mutagenic and toxic for reproduction (CMR)
L’OREAL prohibits the use of any POS and promotional items containing a substance classed as CMR categories 1A and 1B (Classification Labeling Packaging CLP Regulation 1272/2008/EC) in the materials and components of its products including their packaging.
